This Privacy Policy explains how D-Tools, Inc. (“D-Tools” “we” or “us” or “our”) collects, uses, discloses, protects, and processes your information that can be used to identify you or can be tied to you in an identifiable manner (“Personal Information”) through your use of the D-Tools website at https://www.d-tools.com/ and any subdomains thereof (the “Site”) and the services, features, and information available on the Site and/or any mobile applications available via the Apple App Store, Google Play Store, or other publicly available app store (collectively, and together with the Site, along with associated and successor websites, applications, features, information, and services, or any part thereof, the “Service”).

If an organization with which you are associated (an “Organization”) signs up to use our services, we may receive information about you in connection with our provision of such services to your Organization, including your Personal Information. To the extent we process that Personal Information solely in order to provide such services to your Organization, we will act as a processor on behalf of your Organization in respect of that information, which means: we will handle that Personal Information solely at the direction of your Organization; your Organization’s privacy policy (and not this Privacy Policy) will apply to the processing of that Personal Information; and your Organization (and not us) is responsible for obtaining all necessary consents and providing you with all requisite information as required by applicable law. Personal Information We Collect Directly From You

We receive Personal Information directly from you when you provide it to us as part of creating an account, which may include the following categories of Personal Information:

  • Role/title
  • Company name

  • Additional notification email addresses
  • Profile photo

In addition to the other purposes set out in Section 5 below, these categories of Personal Data are processed in order to provide you with Services and secure access to your account; so that you can better and more easily identify yourself to other users on the Site; so that we can communicate with you about the Service and contact you about Service announcements, updates or offers; to understand our user base, including for marketing purposes; and  to provide notifications to you as part of the Service.

Contact Information

We may collect your contact information including name, address, phone number, title and company name, from various sources, including offline marketing activities. 

We process this information for marketing purposes and to provide support to you.

Billing Information
If you who pay by credit card, we will also collect payment information and will associate it with a third-party credit card processor. (We do not store any payment card information ourselves; payment card data is collected and retained by our sub-processor for this information. We retain only the Subscription ID). 

For other paid customers, we will collect and maintain billing information (outside of the website). 

For all paid customers, we maintain a record of Service subscriptions, invoices and payments. 

Billing information and payment records are processed in order to provide Services to our paid customers and to comply with legal and contractual requirements. 

Connection Data
If you access our Site or Service through a third-party connection or log-in or connect an application to D-Tools, that third party you connected with may pass certain information about your use of its service to us. This information could include the user ID associated with your account, an access token necessary to access that service, any information that you have permitted the third party to share with us, and any information you have made public in connection with that third-party service. 

Connection data is processed in order to provide application connectivity, which is part of the Service. 

Online Form, Email and Chat Data

When you fill out an online form, for example to subscribe to a newsletter, or engage in email or online chat communications with us, you may voluntarily supply us contact and other information and we may also retain a record of any communications with you or activities you perform. 

Data from these sources is processed in order to supply you with information that you request from us, and may be used for marketing and analytics purposes.

Event Data
When you register for a D-Tools event, we will collect contact information from you, and when you attend, we will retain a record of your participation. 

Event subscription data is collected in order to provide you with access to events that you have requested. We may also use your contact information for marketing purposes. Event attendance data is processed by us to better understand our user base and for marketing purposes. 

Support Ticket Data
When you submit a support ticket through our systems, we will collect company and contact data, and record activity related to your request. 

Information submitted as part of support tickets is processed by us in order to provide help to you in using the Service, to contact you about your request(s), and to improve our products and services. 

Blogs and Community Forums
D-Tools may offer publicly-accessible blogs or community forums. You should be aware that any information, including Personal Information, provided in these areas may be read, collected, and used by others who access them. If you elect to post something in a public area of our Service, any Personal Information or content that you voluntarily disclose for posting to the Service, becomes available to the public, as controlled by any applicable privacy settings. If you remove information that you posted to the Service, copies may remain viewable in cached and archived pages of the Service, or if other users have copied or saved that information. To request removal of your Personal Information from our blog or community forum, contact us at privacy@d-tools.com. In some cases, we may not be able to remove your Personal Information.

From time to time, we post customer testimonials on the Sites which may contain Personal Information. We obtain the customers’ consent to post their names along with their testimonials.

Personal Information We Receive From Third Party Sources

Some third parties provide us with Personal Information about you, such as the following: 

  • Account information for third party services: If you interact with a third party service when using our Services, such as if you use a third party service to log-in to our Services, or if you share content from our Services through a third party social media service, the third party service will send us information about you, such as information from your public profile, if the third party service and your account settings allow such sharing. The information we receive will depend on the policies and your account settings with the third-party service. 

We process this information in order to provide Single Sign-On, which is part of our Services. 

We may also receive information associated with your use of the website from third-party software: 

  • Augmented tracking data: If you visit our Site and your email or other identifying data is known from interactions with our own Site or with other sites, then our third-party service providers may supply additional information to us, associated with your web browsing activity. This information could include your name, social media user id(s) and profiles, if known and publicly available.

Use and Disclosure of Personal Information

Pursuant to the European Data Protection Laws, legal bases for our processing your information may include (without limitation):  

(A)Your consent. You are able to remove your consent at any time. You can do this by contacting us at privacy@d-tools.com

(B) We have a contractual obligation. We need to process the information to perform under our Terms of Service with you, which enables us to provide you with the Services. When we process data due to contractual necessity, your refusal or failure to provide such Personal Information will result in your inability to use some or all portions of the Services that require such data.  

(C) We have a legal obligation or we have a vital interest or we need to perform a public task. We may need to process Personal Information to comply with a legal obligation, if it is necessary to protect the vital interests of you or other data subjects, or if it is necessary for a task carried out in the public interest. 

(D) we have a legitimate interest (or those of a third party) in providing, improving, or marketing the Service and your interests or fundamental rights and freedoms do not override those legitimate interests.  

In addition to the other purposes set out in this Privacy Policy, we will use Personal Information provided to operate, improve upon, promote, and personalize the Service, for billing and transaction processing, identification, and authentication, to contact and communicate with you about the Service and your use of the Service, to support use of the Service, to send marketing materials as well as sponsored communications from our manufacturer partners (unless you opt out, to the extent permitted by applicable law), for fraud prevention, to analyze Site usage, for troubleshooting problems, and to enforce our Terms of Service. Note that information collected from some cookies placed on the website may be used to deliver advertisements to Site visitors when such visitors are visiting other websites, such as LinkedIn.

Third-Party Processors or Sub-Processors; Other Third Parties

We may disclose Personal Information with third-party service providers, including our Sub-Processors (such as its credit card processors and hosting partners) to provide the necessary hardware, software, networking, storage, and other services we use to operate the Service and maintain a high-quality user experience. The third parties to which we may provide or who may independently directly collect information may include potential or actual advertisers, providers of advertising products or services (including vendors, analytics services providers, and website tracking services), merchants, affiliates and other actual or potential commercial partners, and other similar parties. 

These tools collect information sent by your browser as part of a web page request, including the web pages you visit, your browser add-ons, and other information that assists us in improving the Service. 

We store Personal Information in third-party marketing, CRM and mail-management software, in order to facilitate interactions with users or potential customers.

Analytics and Logs

We may collect and use the analytic information from our own systems and from third parties together with your Personal Information to build a broader profile of our individual users so that we can serve you better.  

We gather certain information automatically and store it in log files. This information includes internet protocol addresses as well as browser and/or device information, internet service provider, referring/exit pages, search terms, operating system, date/time stamp, and clickstream data. Occasionally, we may connect Personal Information to information gathered in our log files, as necessary to improve the Service. Otherwise, we generally use this information as we would any usage data, to analyze trends, administer and maintain the Service, or track usage of various features within the Service.

Other Discolsures of Your Personal Information

We may disclose Personal Information if we believe in good faith that we are required to do so in order to respond to subpoenas, court orders, on legal process, lawful requests by public authorities, including to meet national security or law enforcement requirements, or to establish or exercise our legal rights or defend against legal claims. We may also share such information if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations or our Terms of Service or another contract with us, or as otherwise required by law. 

We may disclose information, including Personal Information with any of our Corporate Affiliates (as defined below), which may include any entity that controls, is controlled by, or under common control with D-Tools.
